What's at stake: Reauthorization of the expired research and development tax credit; restoration of "network neutrality" on the Internet; and proposals to boost what Republicans call "competitiveness" and Democrats have styled "innovation," including changes to the controversial H-1B visa program.

USA has a right to choose who they give green card to but not fool Indian people by swinging visa bulletin by 4 years every now and then. Not by discriminating. There should be some transparency to the process and law should be followed. If USA makes a law that Indians wont get GC in EB, I am happy to note. Can they remove their gloves?

Congrats! I know how relieved you must be feeling.

If you dont mind my asking, did you work at all during these 6 weeks?

Folks I have an update on my case.

We filed for Motion to reopen on which were receipted on March 27th, 2009. I wrote to Congressman, Senators and also Ombudsman. Today my congressman's office got an update that our MTRs were approved on April 30th and our 485s got reopened and they have sent letters to that effect.

What a relief. It was a stressful 6 week ordeal. Thanks to IV and its members for the help and support.

Finally I am a US citizen after being 10+ years in this country. This is one of my biggest fulfillments and it means everything to me. US is just not home anymore for me, it is my country.

I wish everyone the best and hope they get GC very soon.

Proud to be an indian-american and legal immigrant.

    Good Luck!

Can you suggest some credit unions please.

    Thank you.

The one I use is www.1sttech.com (http://www.1sttech.com). They do not require a SSN or ITIN for this, although you can get an ITIN if needed for account opening purposes.

You do not have to add them as joint owners. They ask you to fill out their form and a W8-BEN, following which you get ATM cards that you can mail to your family overseas.

Guys, I know this is immigration forum , so People who are not interested in this thread please ignore.
Considering the State of Markets and Global economy.
    Please throw some ideas..

At this point, I think it makes more sense to become a blood sucking goolti employer. :D

    updated-------->
To the punk you gave me red with the comment "What the fu*K did you mean by goolty? Did some gulti screwed your wife or mother??"
No, actually I was fucked by a GOOLTI not a GULTI like you. And if I find you I will make sure to buttfu*k your Dad & make you Mom suck my di*k later MotherFu*ker. If you Mom is dead, then maybe your GrandMom or Wife or Daughter. Oh, and also learn some grammar, it is "screw" not "screwed", guess they don't teach that in goolti schools huh? Arsehole Fuc**ng lonely inbred loser.

Add to the other who gave me red with "I dont see much difference b/w gulty, Marathi, Tamil, Gujju, Desi, Gora, Iraqui, Irani." I was referring to GOOLTI not GULTI. Visit www.goolti.com know the difference. Gulti's are hardworking Telugu folk, I have no problem with them. GOOLTI's are the blood sucking Employers. Thanks for understanding.

    The oath of allegiance is:

    "I hereby declare, on oath, that I absolutely and entirely renounce and abjure all allegiance and fidelity to any foreign prince, potentate, state, or sovereignty of whom or which I have heretofore been a subject or citizen;
    .......
    ......
    .....

Question: Once one takes US citizenship s/he promises to renounce and abjure all allegiance and fidelity to any foreign prince, potentate or state then how come one confidently say that s/he would still be in love to a home country?

Exactly my thoughts. However, that does not mean that I am not proud of heritage and culture of my country-of-origin.

The vast majority of people are here on these forums for getting their GC and USC.

I appreciate everyone who has congratulated me. Thank you so much. Please note that I sill belong to legal immigrant community and nothing can change that.

Good Luck to everyone (and that includes people who have given me red dots with comments) and I hope you get your GC soon.

    Folks,
This my copyright and very much pertain to our situation:
    *********************
Sometimes I think of going back
Try to gather the courage that I lack
But the world I left is not the same any more.
And the world I am in, has lost its lure.

I am on the crossroad of my life
One is forward, one is left and other is right.
I dont like the choices shown
May be I would have to create a world of my own

    ***************
    Thanks

Very true. You had described the plight of 4 out of five immigrants here.

enjoying life after the GC what else??!!!
answer with complete honesty, if YOU got your green card today, would YOU ever be involved in IV again? except maybe when you want some answers during your naturalization stage?
    :)

    naive....naive.....

I disagree. It all depends on attitude. IV is an organization "for the members", "By the members". If your attitude is "I will get on IV JUST because I WANT something" and "If I got it, I don't care" and "If I have questions during naturalization stage, I will get back on IV" may not mean that you have a great life or enjoy life after GC. Life after GC is not that rosy as you think. Big companies - hiring is the same for GC/h1b so u will not have preference. If you are independent and want to do something on ur own - it is not easy either - it is more stressful and challenging - this is life my friend, 95% of startups fail and these people are seen nowhere after that. Very few people are successful and that too with a lot of difficulties, hard work and faith. The "enjoy life" after GC is generally not U but your next generation (children) will bear the fruits. they will enjoy all the freedom and comforts until reality hits them in form of career and family life - this is something everyone faces.

A lot of people love to be on IV - say, if someone has answered someone's question on IV and the person is benefitted - thie person is extremely happy for the other person.

A lot of people who are active actually love and are passionate about what they are doing. Lot of people want to do their 2 cents or more - this is what this organization is all about.

Over the past 2 years of my association with IV - I have seen a lot of stones turning soft, a lot of people who never wanted to get in, are now very active and highly motivated.

So it all depends on attitude.

This will help people like me who are unable to be part of any state chapter to know what is happening at IV. Keep our sprits high.

    Thank you

You can join one of the existing state chapters for now.

For those who are not able to put their faith in the efforts of the IV Core, too bad you didn't volunteer and participate in lobby day last September.

If you had been there, you would not suspect the motives or say things like they are taking credit for good news etc.. It is very disappointing to hear that.

I think it is reasonable that we won't be getting day-to-day updates and details on the background efforts. From my side, I have enough trust in the organization that when IV asks for the participation of the community, I will support it whole-heartedly.

No, 45 days condition is not for "to file 140 within 45 days of labor approval"
But it is for the company to substitute the LC for some other employee within 45 days.

There is no time limit set to file I-140 for the employee for whom the LC was issued.Where do you get this from? In original proposal it was 45 days to file I-140, after that day labor just dies. Company can request substitution only before labor approval.

    http://a257.g.akamaitech.net/7/257/2422/01jan20061800/edocket.access.gpo.gov/2006/pdf/06-1248.pdf

    First, DOL is proposing to
    eliminate the current practice of
    allowing the substitution of alien
    beneficiaries on permanent labor
    certification applications and resulting
    certifications. Second, DOL is proposing
a 45-day period for employers to file
    approved permanent labor certifications
in support of a petition with the
    Department of Homeland Security,
    United States Citizenship and
    Immigration Services (DHS).

Techy wont bother us again. Say TA-TA to techy2468.

Sorry this thread took an ugly turn with techy's profanity and inflammatory comments.

Wrong Action Logiclife. Your action does not make any logic nor does it makes sense in free life..

You want to get Green Card and become citizen of a country that gives you freedom of everything including freedom of speech, and you deny the same to people in this forum...in name of moderation or whatever you want to call it do you understand you try and control THE ONLY ONE THING YOU CAN CONROL in this forum the freedom of speech and feel proud about it (Say TA-TA to techy2468).. What if you had more things in your control,, would you be lot different from a dictator or a control freak.. ask your self

Sorry but this act of administrator(s) of banning people from threads or moderating every threads, goes against the very principle of this country part of which we all want to be. Let Freedom Prevail in everything even if it disturbs you or is not pleasing to your ears, We are after all using a media called internet for our cause which itself stands on this very foundation of Freedom of Information and speech.. For a moment think what this whole movement of IV would have been if the internet was controlled.. like you control the threads

Dont take away a right that this country gives you even as in immigrant, unlike lot of people who are a part of this forum and have experienced what denial of Freedom of speech feels like back in their home countries

PS: Dont go ahead and ban this post in a state of denial

It is simple: you could have a PhD and be on H1B but still not qualify for EB2 classification if the job you are in does not require enough education and/or experience to fall under EB2 classification.

You do NOT require Master's degree for EB2 classification or for H1B. The law does require "related field" but does not clearly specify computer science or anything.
    You do require enough experience.
When applying for GC or during the stages, Educational Equivalency to US accredited Universities will have to be shown. This is the stage you might have an issue with showing that it is equivalent.

There have been thousands of instances where applicants have been disqualified from applying for GC and even their H1B revoked when initial degree was found to not be related to the occupation - examples: B.Com, B.Sc (Bio, Geology..except Physics/Math), B.Arch.
USCIS is now very strict. :( -but for the betterment of the whole system.

    Hey,

I have Bachelor's computer's 3 years and MCA 2 years from IGNOU. I have over 7 years of Exp excluding frm my current company. Is EB2 possible in my case. My employer says its not cause of my education, can anybody let me know if they have done EB2 with this scenario. Appreciate your time. Thanks
